HOLD HARMLESS AGREEMENT

This Hold Harmless Agreement ("Agreement") is entered into as of the date signed below by and between Shakir Miller, Miller Holdings Corp, located at 26196 Dark Star Trail (Dark Star Farms), Brooksville, Florida 34601, and Darkstar Family Properties (collectively referred to as "Property Owners"), and the undersigned visitor ("Visitor").


1. Purpose

This Agreement is intended to release and hold harmless the Property Owners from any and all liability, claims, demands, damages, or causes of action arising out of or related to any injury, loss, or damage that may occur to the Visitor, any minor(s) under the Visitor’s supervision, or the Visitor’s property while on the premises of Dark Star Farms and/or the adjacent property owned by Darkstar Family Properties ("Properties").


2. Acknowledgment of Risks

The Visitor acknowledges that visiting an agricultural property and adjacent lands includes inherent risks, which may include but are not limited to:

  • Uneven terrain, holes, and other natural land conditions
  • Interaction with livestock, animals, and wildlife
  • Exposure to farm equipment and machinery
  • Weather-related hazards
  • Allergens, insects, and other environmental factors
  • Firearms - gunfire and ricochets
  • Open fires - ex. bonfires

The Visitor further acknowledges that these risks apply equally to any minor(s) under their supervision. The Visitor accepts full responsibility for the safety and supervision of said minors while on the Properties.


3. Release and Hold Harmless

In consideration of being permitted to visit the Properties, the Visitor hereby agrees to release, waive, discharge, and hold harmless the Property Owners, their agents, employees, heirs, successors, and assigns from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by the Visitor, any minor(s) under their supervision, or any property belonging to the Visitor or said minors, whether caused by the negligence of the Property Owners or otherwise, while on the Properties.


4. Indemnification

The Visitor agrees to indemnify and hold harmless the Property Owners from any loss, liability, damage, or costs, including court costs and attorney's fees, that may be incurred due to the presence or actions of the Visitor or any minor(s) under their supervision on the Properties, whether caused by the negligence of the Property Owners or otherwise.


5. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under or related in any way to this Agreement shall be resolved in the appropriate courts of Hernando County, Florida.


6. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.


7. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes any prior understanding or representation of any kind preceding the date of this Agreement.


Visitor Information & Acknowledgment

By signing below, the Visitor acknowledges that they have read this Agreement, fully understand its terms, understand that they have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement. The Visitor further acknowledges full responsibility for any minor(s) (whether you omit their name(s) from this form or not) under their supervision and agrees to ensure their compliance with all safety instructions and guidelines while on the Properties.

This Agreement shall remain in effect for a period of two (2) years from the date signed below.
